1. Acceptance of Terms

By accessing or using WidgetSpark, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree with any part of these terms, you must not use the application. Your continued use of WidgetSpark constitutes acceptance of any updates or modifications to these terms.

2. Description of Service

WidgetSpark is a desktop widget application designed for Windows. It provides a collection of customizable widgets including system monitors, media players, audio visualizers, productivity tools, games, and more. The application runs on your desktop and allows you to personalize your workspace with functional and visually appealing widgets.

3. User Accounts & Subscriptions

WidgetSpark offers both Free and Pro subscription plans. The Free plan provides access to a curated set of basic widgets. The Pro plan unlocks the full library of 50+ widgets, premium themes, and priority support.

Pro subscriptions are billed through Stripe. By subscribing, you authorize recurring charges at the applicable rate until you cancel. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain Pro access until the end of your current billing period.

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

When using WidgetSpark, you agree not to:

• Reverse engineer, decompile, or disassemble the application or any of its components
• Redistribute, resell, or sublicense the application or any part of it
• Remove or alter any proprietary notices, labels, or marks
• Use the application to develop a competing product or service
• Attempt to circumvent subscription restrictions or access Pro features without a valid subscription
• Use the application in any manner that violates applicable laws or regulations

5. Intellectual Property

All content within WidgetSpark, including but not limited to widgets, source code, designs, graphics, icons, animations, and documentation, is the intellectual property of WidgetSpark and is protected by copyright and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to use the application for personal or internal business purposes. This license does not transfer any ownership rights to you.

6. Disclaimer of Warranties

WidgetSpark is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the application will be uninterrupted, error-free, or free of harmful components. Your use of WidgetSpark is at your own risk.

We make no guarantees regarding the accuracy, reliability, or completeness of any data displayed by widgets, including but not limited to system information, weather data, or network statistics.

7. Limitation of Liability

To the maximum extent permitted by applicable law, WidgetSpark and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the application.

Our total liability for any claims arising under these terms shall not exceed the amount you have paid to WidgetSpark in the twelve months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account and access to WidgetSpark at our discretion if you violate these Terms of Service or engage in conduct that we determine to be harmful to the application, other users, or our business interests.

Upon termination, your right to use the application ceases immediately. Any provisions of these terms that by their nature should survive termination will remain in effect, including intellectual property provisions, disclaimers, and limitations of liability.

9. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices, features, or legal requirements. When we make significant changes, we will notify you through the application or by email. Your continued use of WidgetSpark after changes are posted constitutes your acceptance of the revised terms.
